The revision of the OREVT1 CR/TE is the result of situations which arose in 2007
when our internal form was inadvertently provided to external sources. The form
is for internal use only and not intended for distribution or use outside NRCS.
This includes the landowner and other agencies, including the State Historic
Preservation Office (SHPO). In order to reduce the risk of this information
being disclosed we have updated the form to add a disclaimer at the top. The
heading reads; “CONFIDENTIAL – INTERNAL USE ONLY – UNAUTHORIZED DISCLOSURE MAY
VIOLATE 5 USC 552 AND /OR 36 CFR 800.11.”
The referenced code 5 USC 552, which generally makes agency business public, has
an exception which allows NRCS to keep confidential anything protected from
disclosure by another statute. Thus, under 5 USC 552, the Farm Bill privacy act
provisions allow NRCS to keep information confidential which would otherwise be
subject to public disclosure laws. The 36 CFR 800 code is the regulation for the
National Historic Preservation Act. Section 800.11c has a confidentiality clause
which allows NRCS to withhold from public disclosure any information about the
location, character, or ownership of a cultural resource site in order to
protect the site from potential damage, as well as for privacy concerns.
The form is the only form which will be accepted for cultural resource requests
from this point forward. Any other version of the form received will be returned
to the sender.
